(1st) First Offense DUI/DWI in New Jersey
The State of New Jersey has a zero tolerance policy towards driving under the influence (DUI) and the penalties for a first offense DUI can be severe. These penalties can include fines and jail time, and they increase depending on the offender’s intoxication level as determined by a breathalyzer test. Fines and Penalties for First Offense DUI in NJ
Depending on the Blood Alcohol Content (BAC) determined by the breathalyzer test, an individual will face the appropriate penalties:
Fines and penalties between 0.08% and 0.10% BAC:
- License suspension for three months
- Fines between $250 and $400, with the possibility of additional fees and surcharges
- 12 to 48 hours Intoxicated Driver Resource Center (IDRC)
- Jail time up to 30 days
Fines and penalties for over 0.10% BAC:
- License suspension for one year

Additional fines and penalties:
- After your license is restored, you may be required to install an ignition interlock device (IID) if your BAC was .15% or higher.
- Driving with an open container carries a first offense fine of $200.
- If the individual is under 21, penalties can be incurred for a BAC higher than 0.01% and may include 15 to 30 days of community service in addition to the penalties listed above.
- Residents of NJ are required to take a breathalyser test due to an implied consent law. Refusing to take the test is considered equal to driving with a BAC of .10% and can result in more severe penalties.
- Driving with a DUI suspended license can result in your license being suspended for an additional 1 to 2 years.
